Terms of Service

Streamea ("Platform", "we", "us") is operated by Marcos Hernandez, an autónomo (sole trader) registered in Spain (NIF: [OPERATOR_NIF], address: [OPERATOR_ADDRESS]).

You must be at least 18 years old to use Streamea. By creating an account, you confirm that you meet this requirement. If we discover that a user is under 18, we will immediately terminate the account and forfeit any token balance.

Streamea is not available in certain jurisdictions due to legal requirements. See section 9 (Availability) below.

• You may register with an email address or a Google account.
• You are responsible for maintaining the confidentiality of your credentials.
• One account per person. Shared or resold accounts are prohibited.
• You must provide accurate registration information and keep it up to date.
• You may not impersonate another person or entity.

Streamea is a live-only streaming platform. We do not record, archive, or store streams — content is ephemeral by design. Once a stream ends, it is gone.

Creators may broadcast live video. By streaming you grant Streamea a limited, non-exclusive, royalty-free licence to transmit your content to viewers during the live session only. You retain all ownership of your content.

You must not stream content that:

• Sexually exploits or depicts minors.
• Is non-consensual intimate content.
• Incites violence, terrorism, or hatred based on protected characteristics.
• Is illegal under Spanish law or the applicable law of the viewer's jurisdiction.
• Constitutes spam, phishing, or malware distribution.
• Infringes the intellectual property rights of a third party.

We reserve the right to suspend or terminate any stream or account that violates these rules without prior notice.

Streamea operates a virtual token system (✦). Key terms:

• 1 ✦ = €0.01. Tokens are purchased in bundles and used for tips, reactions, and interactions.
• Maximum wallet balance: €500 / 50,000 ✦.
• Tokens do not expire and have no cash redemption value for viewers.
• Streamea is not a bank or e-money institution. Token purchases are non-refundable except as required by EU/Spanish consumer law.
• Creators earn EUR directly. The platform retains 30% of token spend directed to a creator; the creator receives 70%.
• Minimum creator payout: €25. Payouts are processed weekly.
• Creators must complete Stripe Connect onboarding and KYC verification before receiving any payout.
• We reserve the right to withhold payouts pending investigation of policy violations.

• Creator Subscription (~€7.99/month): unlocks full streaming capabilities, 1080p broadcast, and monetisation features.
• Viewer Subscription (~€4.99/month): unlocks unlimited viewing, 1080p playback, full chat, and a monthly token grant.
• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you retain access until then.
• Prices may change with 30 days' notice.

The Streamea name, logo, and software are the intellectual property of Marcos Hernandez. Nothing in these Terms transfers any ownership of our intellectual property to you.

You retain full ownership of content you create and broadcast. You grant us no rights beyond what is strictly necessary to operate the platform (transmit your live stream to viewers during the session).

Streamea operates three viewer tiers:

• Anonymous: 15 minutes/day, 480p, read-only. No account required.
• Free account: 1 hour/day, 720p, slow-mode chat, can tip. Uncapped during first 7 days; never cut mid-stream.
• Paid subscriber: Unlimited viewing, 1080p, full chat, monthly token grant.

We reserve the right to modify tier limits at any time with reasonable notice.

Streamea is not available in the following territories due to legal requirements:

• United Kingdom
• United States: Texas, Louisiana, Utah, Mississippi
• Jurisdictions subject to EU, UN, or US OFAC sanctions (currently including Cuba, Iran, North Korea, Syria, Russia, Belarus)

Access from these territories is blocked automatically. We make no representations as to whether the platform is appropriate or available for use in other locations.

To the maximum extent permitted by applicable law, Streamea is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our total aggregate liability to you shall not exceed the amounts you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under mandatory Spanish or EU consumer law.

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law.

You may delete your account at any time from your account settings. Upon termination: your token balance is forfeited (subject to any refund rights under applicable law); active subscriptions are cancelled; and your data is handled as described in our Privacy Policy.

We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use of the platform after the effective date constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Spain. You agree to submit to the exclusive jurisdiction of the courts of Spain for any dispute arising out of or relating to these Terms or your use of the platform.

This choice of law does not deprive you of any protection afforded by mandatory provisions of the law of your country of habitual residence within the European Union.
